By accessing or using the Miss Callaway service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Miss Callaway ("we," "us," or "our").
Miss Callaway provides an AI-powered phone receptionist service for business customers. The Service answers inbound calls on behalf of your business, conducts caller intake, captures lead information, and delivers call summaries and recordings to your designated email address.
The Service is provided on a subscription basis. By activating a subscription or free trial, you authorize us to provide the Service as described in these Terms.
We offer a 7-day free trial for new customers. A valid payment method is required at trial activation. Your payment method will not be charged during the trial period. If you cancel before the end of day 7, no charge will be made. If you do not cancel before the end of day 7, your subscription will automatically commence and your payment method will be charged the applicable monthly fee.
The Service is billed at $199 per month per business following the free trial period. Billing occurs on the same day each month from the date your subscription commences. Payment is processed securely via Stripe. All major credit and debit cards are accepted.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No partial refunds are issued for unused portions of a billing period.
Each subscription includes 500 minutes of call time per month. Minutes are counted from the moment Miss Callaway answers a call to the moment the call ends.
If your monthly usage exceeds 500 minutes, overage is billed at $0.18 per minute. Overage charges are added to your next monthly invoice. You will not be notified in advance when you approach or exceed your monthly allowance. It is your responsibility to monitor your usage.
The Service records all calls handled by Miss Callaway. By using the Service, you acknowledge and agree that:
You agree not to use the Service for any unlawful purpose, or in any manner that could damage, disable, or impair the Service. You are solely responsible for all activity that occurs under your account.
The Service is intended for legitimate business use only. Use of the Service for fraudulent, deceptive, or harassing purposes is strictly prohibited and will result in immediate termination of your account without refund.
We aim to provide the Service on a 24/7 basis. However, we do not guarantee uninterrupted availability and are not liable for any downtime, interruptions, or service failures. Scheduled maintenance will be performed with reasonable notice where possible.
To the maximum extent permitted by applicable law, Miss Callaway shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability to you for any claims arising from or related to the Service shall not exceed the amount paid by you to us in the three months preceding the claim.
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the Service after such changes constitutes your acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable rules.
